A group of lawyers of the company LexProf won a precedent decision in favor of the client on recognizing the ceased bank guarantee in the part corresponding to the part of the executed obligation.
The mechanism of reduction was laid down in the text of the bank guarantee, therefore the lawyers of LexProf proved that in this case the principle of independence of the bank guarantee, specified by Article 370 of the Civil Code of the Russian Federation is not applicable.
